DECIDES

Article 1. Promulgating the pilot process of inter-operating administrative procedures for issuing vouchers Criminal records No. 01, No. 02 and issue of work permits to foreign workers working at enterprises in industrial zones of Dong Nai province.

Article 2. This Decision takes effect 10 days after its signing.

Article 3. Chief of Office of Provincial People's Committee, Directors and Heads of departments, divisions and branches; Chairmen of People's Committees of districts, Long Khanh city, Bien Hoa city, Chairman of People's Committees of communes, wards and townships, Provincial Public Administration Center, Provincial Post Office and relevant organizations and individuals are responsible for implementing implementation of this Decision.

OF IMPLEMENTATION OF INTERNAL ADMINISTRATIVE PROCEDURES FOR GRANT OF JUSTICE RECORDS NUMBER 01, NUMBER 02 AND ISSUANCE OF WORKING PERMITS IN OTHER WORKERS DONG NAI PROVINCE Industrial Park

Chapter I

GENERAL PROVISIONS

Article 1. Scope, objects, principles Application

1. The implementation of inter-related administrative procedures under this Process shall be carried out between the procedures for issuance of judicial record cards No. 01 and No. 02 and the issuance of work permits (hereinafter referred to as inter-connected procedures). for foreign workers working at enterprises in Industrial Parks (IZs) of Dong Nai province.

2. Subjects of application are the state management agencies involved in administrative procedures (the Management Board of Industrial Parks and the Department of Justice of Dong Nai province), enterprises employing human workers. foreigners, foreign workers residing in Vietnam.

3. The implementation of procedures for issuance of judicial record cards is the basis for processing work permits for foreign workers when working at enterprises in industrial zones of Dong Nai province.

4. The applicant has the right to choose whether or not to perform administrative procedures in accordance with this Process. When using the interconnection procedure, the applicant can receive the previous results of the administrative procedure that has been resolved or receive the results of the administrative procedure at the same time according to the process of the interconnected procedure.

In case of choosing not to apply the interconnected process, the implementation of each procedure will be in accordance with the current legal provisions for each type of administrative procedure.

Article 2. Agencies and units implementing the inter-connection process

1. The receiving and returning department of the Management Board of Dong Nai Industrial Parks at the Center of Public Administration of Dong Nai Province (hereinafter referred to as the Receiving Department) received by the Management Board) is the focal point to receive the dossiers and return the results for the interoperability procedures carried out in accordance with this Procedure.

2. The one-stop-shop division of the Department of Justice and the one-stop-shop division of the Dong Nai Industrial Zones Management Board are the units that receive and transfer the application for the issuance of a criminal record card and work permit for the person. Specialized departments process and return results to departments according to the process.

3. Dong Nai Industrial Zones Management Board is the agency that handles procedures for granting work permits to foreign workers working at enterprises in Dong Nai industrial zones.

4. Dong Nai Department of Justice is the agency that handles procedures for granting judicial record cards to foreign workers already residing in Vietnam.

5. Postal service provider is a unit that participates in the transfer of administrative documents between agencies and performs the service of receiving and returning results at the request of enterprises carrying out administrative procedures.

Chapter II

IMPLEMENTATION PROCESS

Article 3. Procedures for handling dossiers in the inter-connected implementation process

1. In the process of inter-operating implementation, enterprises only have to submit 01 set of dossiers including the components as prescribed. of two inter-connected administrative procedures for the receiving department of the Management Board. In case there are overlapping documents between the two procedures, the applicant only needs to submit 01 certified true copy and 01 photocopy (with the original for comparison).

2. The composition of dossiers for issuance of judicial record cards and dossiers for issuance of work permits to foreign workers shall comply with the provisions of the Labor Code, the Law on Judicial Records and guiding documents. Specific content is made according to the Appendix of this Procedure.

Chapter III

ORGANIZATION OF IMPLEMENTATION

Article 4. Office of the Provincial People's Committee The

Office of the Provincial People's Committee is responsible for printing and photocopying into a book linking administrative procedures that have been announced and distributed to the units according to the composition of the recipient's location. This decision; update the administrative procedure content that has been published on the Government's National Database.

Article 5. Responsibilities of Dong Nai Industrial Zones Management Board and Department of Justice

1. Dong Nai Industrial Zones Management Board and Department of Justice publicly implement the inter-connection process, administrative procedures and organize the implementation of the Process. this.

2. The Management Board of Dong Nai Industrial Parks and the Department of Justice jointly organize training, guide professional processes, requirements and procedures, how to use the one-stop public service system for staff. The ministry of civil servants shall carry out the inter-connection procedures of the Management Board of Dong Nai Industrial Zones and the Department of Justice.

3. The Management Board of Dong Nai Industrial Parks and the Department of Justice coordinate in implementing information and propaganda in appropriate forms and widely disseminating them to organizations and enterprises employing foreign workers and employees. foreign countries are easily accessible and implemented when needed.

4. Dong Nai Industrial Zones Management Board shall assume the prime responsibility for monitoring the implementation of this Process, act as the focal point to receive information, and coordinate with relevant agencies to exchange, agree and submit to the People's Committee. province decided to consider amending this Procedure.

 

Article 6. Department of Information and Communications

1. Coordinating with Dong Nai Industrial Zones Management Board and Department of Justice to update the content, configure the process of interoperating administrative procedures that have been published on the Single Window Software. (Egov) of the province for use by agencies, organizations and businesses.

2. To take technical responsibility for the electronic system to carry out interoperability procedures.

3. Organize training and guide agencies and units to carry out inter-procedural procedures in using and manipulating the process on the electronic 1-door system, the province's electronic public service portal.

Article 7. Provincial Post Offices

1. Strictly comply with regulations on receiving and returning results of administrative procedures settlement via postal services at the request of organizations and individuals.

2. Coordinating with competent agencies in guiding inter-connection procedures to train and guide postal staff on professional processes related to the receipt and return of documents and results of handling procedures administrative.

3. Organize the collection of fees and charges for handling administrative procedures, charges for document delivery services, and results of handling administrative procedures via postal services. To fully and on time pay fees and charges collected from organizations and individuals to competent agencies.

4. Disseminate widely to organizations and individuals about receiving dossiers and returning results of administrative procedures settlement via postal services./.

 

APPENDIX

Procedures for issuance of judicial record cards No. 01, No. 02 and issuance of work permits to foreign workers

a ) Order of implementation:

- Step 1: The enterprise submits the application, the receiving department of the Management Board receives the dossier, checks the completeness and legality of the dossier:

+ In case of incomplete input items and components of the dossier as prescribed, and guide enterprises to re-prepare the dossier;

+ In case the application meets the requirements, receive and input the file information into the one-stop software, print the receipt and schedule a date to return the results

- Step 2: Transfer the application for issuance of the criminal record card to Department of Justice to deal with; transfer the work permit dossier to the Management Board of Industrial Parks. In case of receiving paper dossiers, the receiving department of the Management Board will scan the entire dossier and transfer the necessary data to the Department of Justice to handle the procedure for issuance of criminal records.

The transfer of records is done through the post office and the egov database system.

- Step 3: The Department of Justice processes the Judicial Records file, enters the status of the results of the application, scans the results of the Criminal Record form and transfers the settlement results to the Management Board of the Industrial Parks.

In case more time is needed for verification (as prescribed by law), within 01 day before the end of the implementation process of the procedure for issuance of judicial record cards, the Department of Justice is responsible for notifying extension of time for settlement by sending an electronic document to the receiving department of the Management Board to notify the extension of the time limit for returning the results of inter-connected procedures to the enterprise.

In case the dossier is not eligible for settlement of a criminal record card, within 03 working days from the date of receipt of the dossier, there is an additional notice, ineligible for settlement, and send it to the Management Board of IZs and IZs. enterprises to adjust and supplement.

The results of the Criminal Record and Additional Notice of Ineligibility are sent through the post office and the egov data system.

- Step 4: The Management Board of IZs handles the work permit application, enters the results of the application and delivers the results of the application (including the criminal record card and the work permit) to the receiving department. and return the results at the Management Board to pay the business.

In case the application does not fully satisfy the conditions of the work permit granting procedure, a written explanation of the reason shall be sent to the enterprise and a notification shall be sent to the enterprise for adjustment and supplementation.

- Step 5: The department that receives and returns the results at the Management Board returns the results directly or through the postal service system to the business.

b) Method of implementation:

- Submit directly at the Provincial Public Administration Center (6th Floor, Sonadezi Building, Street 1, Bien Hoa 1 Industrial Park, An Binh Ward, Bien Hoa City, Dong Nai Province);

- By postal service upon request;

c) Composition and number of dossiers:

c.1. Components of the application file:

* Dossier for issuance of a criminal record card

+ A declaration requesting the issuance of a criminal record card according to the prescribed form (Form No. 03/2013/TT-LLTP; Form No. 04/2013/TT-LLTP) .

+ A copy of the people's identity card, citizen identification card or passport of the person issued with the judicial record card; Copy of household registration book, temporary residence book, certificate of permanent or temporary residence of the person who is issued with a judicial record card (if a photocopy is submitted, the original must be presented for comparison. for comparison, submit a certified true copy as prescribed by law).

+ Power of attorney in case of authorizing another person to carry out the procedures for requesting the issuance of a judicial record card No. 1 (in case the authorized person is the father, mother, wife, husband, or child of the authorizing person, it is not necessary to issue a letter of authorization). written authorization but must present documents proving the relationship). The power of attorney must be notarized and authenticated in accordance with Vietnamese law.

Individuals requesting the issuance of Criminal Record Cards No. 2 may not authorize others to carry out the procedures for requesting the issuance of Criminal Record Cards.

+ A copy of the person's identity card, citizen identification card or passport of the authorized person (in case of authorization requesting the issuance of judicial record card No. 1).

In addition, the requester for the issuance of a judicial record card is subject to exemption or is required to provide judicial record information of students, people with meritorious services to the revolution, and relatives of martyrs (including fathers and mothers). birth, natural mother, wife (or husband), children (natural children, adopted children), people who have contributed to raising martyrs) must present papers to prove it.

* Dossier for grant of work permitemployer's

- Health certificate issued abroad or in Vietnam according to regulations of the Ministry of Health.

- A written certification that he is not a criminal or is examined for penal liability in accordance with Vietnamese and foreign laws, valid for a period of 06 months, up to the time of application submission. may be as follows:

- For foreigners already residing in Vietnam: Criminal record card issued by Vietnam;

- For foreigners who have never resided in Vietnam: A criminal record card or written certification that the foreign worker is not a criminal or is prosecuted for penal liability by a foreign country;

- A written certification of being a manager, executive director, expert or technical worker, as follows:

For foreign workers who are managers or executive directors, one of the following must be present: The following documents:

+ Papers proving that the foreign worker is a manager or executive director, including: a work permit or a labor contract or an appointment decision confirming that the foreign worker has worked in a managerial position. manager, executive director;

+ A document certifying that the foreign worker is a manager or executive director, certified by the agency, organization or enterprise that the foreign worker has worked for.

For foreign workers who are experts, they must have one of the following papers:

+ Papers proving that the foreign worker has an engineer, bachelor's degree or higher or equivalent and has at least 3 years of experience. working in a specialized training that is relevant to the job position in which the foreign worker is expected to work in Vietnam; or

+ A written certification of being an expert recognized by a competent agency, organization or enterprise in a foreign country.

For foreign workers who are technical workers, the following papers are required:

+ Proof or written certification of overseas agencies, organizations or enterprises that they have received specialized training. technical or other major with a period of at least 01 year suitable to the position in which the foreign worker is expected to work in Vietnam;

+ Papers proving that the foreign worker has at least 03 years of working in the technical profession, and is trained in accordance with the position that the foreign worker is expected to work in Vietnam.

For some occupations, jobs, documents certifying professional qualifications, technical of foreign workers being replaced by one of the following documents:

+ Paper recognized as craftsmen of traditional crafts issued by a competent authority of a foreign country;

+ Documents proving the experience of foreign football players;

+ Air transport aircraft driver's license issued by a competent Vietnamese agency to foreign pilots;

+ An aircraft maintenance license issued by a competent Vietnamese agency to foreign workers doing aircraft maintenance.

- 02 color photos (size 4cm x 6cm, bare head, front view, clear face, clear ears, no glasses, white background), photos taken not older than 06 months by the time of application submission.

- A copy of the passport or a valid document in lieu of a passport or a valid international travel document as prescribed by law.

Health certificate; written confirmation that the person is not an offender or is being examined for penal liability; The written certification of being a manager, executive director, expert or technical worker is 01 original or 01 notarized copy as prescribed by Vietnamese law or foreign law, if in foreign language. In addition, consular legalization must be obtained, except for cases where consular legalization is exempted under international treaties to which the Socialist Republic of Vietnam and related foreign countries are members or on the principle of reciprocity. or according to the provisions of law and translated into Vietnamese, authenticated in accordance with the provisions of the law of Vietnam.

- Documents related to foreign workers:

+ For foreign workers working in the form of intra-enterprise relocation, there must be a document from the foreign enterprise sending to work at the commercial presence. of that foreign enterprise in the Vietnamese territory and documents proving that the foreign worker has been recruited by that foreign enterprise at least 12 months before working in Vietnam;

+ For foreign employees working in the form of performing various types of contracts or agreements on economics, commerce, finance, banking, insurance, science and technology, culture, sports, education. education, vocational training and health care must have a contract or agreement signed between the Vietnamese side and the foreign side, in which there must be an agreement on the foreign workers working in Vietnam;

+ For foreign workers in the form of contract service providers, there must be a service provision contract signed between the Vietnamese and foreign partners and a document proving that the foreign worker has working for a foreign enterprise without a commercial presence in Vietnam for at least 02 years;

+ For foreign workers working in the form of service offering, there must be a document from the service provider sending foreign workers into Vietnam to negotiate service provision;

+ For foreign workers working under the form of working for foreign non-governmental organizations, international organizations in Vietnam that are allowed to operate under Vietnamese law must have a certificate of organization. foreign non-governmental organizations and international organizations permitted to operate in accordance with Vietnamese law;

+ For foreign employees working in the form of persons responsible for establishing a commercial presence, there must be a document from the service provider sending the foreign worker to Vietnam to establish the commercial presence of the foreign worker. that service provider;

+ For foreign employees working in the form of managers, executives, experts or technicians who participate in activities of foreign enterprises that have established commercial presence in Vietnam. there must be documents proving that the foreign worker is allowed to participate in the activities of that foreign enterprise.

The above documents are 01 photocopy enclosed with the original for comparison or 01 certified copy. If in foreign language, consular legalization is exempted, but must be translated into Vietnamese and authenticated according to the provisions of law. law of Vietnam.

* Issuance of a work permit (work permit) in some special cases (the work permit has been granted, now there is a change):

* Same working position, work permit expires;

+ The employer's written request for a work permit;

+ A health certificate or medical examination certificate issued by a competent foreign or Vietnamese medical agency or organization is valid for 12 months from the date of signing the health conclusion to the date of submission. file;

+ A written certification that the person is not an offender or is being examined for penal liability;

+ 02 color photos (size 4cm x 6cm, white background, straight face, bare head, no colored glasses), photos taken within 06 months from the date of application

+ Copy of passport or valid documents the replacement value of passports or valid international travel documents as prescribed by law;

d) Time limit for settlement:

The time to carry out the inter-connected procedures under this Process is 18 working days, in which, the processing time for the criminal record card is 15 days, the processing time for the issuance of criminal records is 15 days. Work permit is 3 days.

e) Subjects carrying out administrative procedures: Individuals, organizations.

f) The agency carrying out administrative procedures: Dong Nai Industrial Zones Management Board shall assume the prime responsibility for, and coordinate with the Department of Justice,

g) Results of administrative procedures: Work permits for foreign workers in Viet Nam; Judicial record cards No. 1, 2;

h) Fees and charges:

- Fees for issuance of work permits: 600,000 VND/working permit (six hundred thousand VND).

- Fee for providing criminal record information 200,000 VND/time/person (two hundred thousand VND).

In case the person requesting the issue of a judicial record card requests to issue two judicial record cards in a single request, from the third card onward, the agency issuing the criminal record card will collect an additional 5,000 VND/. vouchers to cover the necessary expenses for the printing of the Criminal Record form.

i) Name of application form, declaration form:

- Written request for a work permit for foreign workers (Form No. 7 enclosed with Circular No. 40/2016/TT-BLDTBXH).

- A declaration requesting the issuance of a judicial record card (Form No. 03/2013/TT-LLTP);

- A declaration requesting the issuance of a criminal record card (for individuals in case of authorization to request the issuance of a criminal record record card No. 1 and the individual being the parent of a minor who requests the issuance of a criminal record card). Law No. 2) (Form No. 04/2013/TT-LLTP).

j) Requirements and conditions for carrying out administrative procedures: Persons who are granted work permits and judicial record cards must fully satisfy the following conditions:

- Have full civil act capacity as prescribed by law. the law.

- Have health suitable for job requirements.

- As a manager, executive director, expert or technical worker.

Foreign workers who practice medical examination and treatment, directly provide medical examination and treatment in Vietnam or work in the field of education, training and vocational training must fully satisfy the conditions prescribed by law. Vietnamese law on medical examination, treatment, education, training and vocational training.

- Not being a criminal or being examined for penal liability in accordance with Vietnamese and foreign laws.

- Get the written approval of the competent state agency on the employment of foreign workers.

- Decree No. 11/2016/ND-CP dated February 3, 2016 of the Government detailing the implementation of a number of articles of the Labor Code regarding foreign workers working in Vietnam;

- Decree No. 140/2018/ND-CP dated October 8, 2018 of the Government providing for amendments and supplements to Decrees related to business investment conditions and administrative procedures under its management. State management of the Ministry of Labor - Invalids and Social Affairs;
