Pursuant to Decision No. 2455/QD-UBND dated July 17, 2018 of the Chairman of Dong Nai Provincial People's Committee on amending the inter-procedural procedures for granting work permits to foreign workers working in Vietnam, granting judicial records No. 1, No. 2 and notarized translation services;

At the proposal of the Director of the Department of Labor, War Invalids and Social Affairs in Report No. 184/TTr-LDTBXH dated October 30, 2019,

DECIDES:

Article 1. Promulgating a pilot process for inter-operating administrative procedures Officially issue Judicial Records Cards No. 1, No. 2 and issue Work Permits to foreign workers working at enterprises outside the Dong Nai Industrial Park (attached to the process).

Article 2. This Decision takes effect from the date of signing. Replacing Decision No. 4346/QD-UBND dated December 4, 2017 of the Chairman of Dong Nai People's Committee on promulgating the Regulation on coordination in interoperability of administrative procedures for granting work permits to foreign workers. in addition to working in Vietnam, issuing judicial record cards No. 1 and No. 2 and notarized translation services in Dong Nai province; and Decision No. 2455/QD-UBND dated July 17, 2018 of the Chairman of Dong Nai People's Committee on amending the inter-procedural procedures for granting work permits to foreign workers working in Vietnam, granting the judicial calendar No. 1, No. 2 and notarized translation services.

Chapter I

GENERAL PROVISIONS

Article 1. Scope, subjects and principles of application

1. Implementation Interoperable administrative procedures under this Process shall be carried out between the procedures for issuance of judicial record cards No. 01 and No. 02 and the issuance of work permits (hereinafter referred to as inter-connected procedures) for foreign workers working in the country. working at enterprises outside industrial zones (IZs) in Dong Nai province.

2. Subjects of application are state management agencies related to administrative procedures (Department of Labor - Invalids and Social Affairs and Department of Justice of Dong Nai province), enterprises employing laborers. are foreigners, foreign workers residing in Vietnam.

3. The implementation of procedures for issuance of judicial record cards is the basis for processing work permits for foreign workers when working at enterprises outside the industrial zone of Dong Nai province.

4. The applicant has the right to choose whether or not to perform administrative procedures in accordance with this Process. When using the interconnection procedure, the applicant can receive the previous results of the administrative procedure that has been resolved or receive the results of the administrative procedure at the same time according to the process of the interconnected procedure.

In case of choosing not to apply the interconnected process, the implementation of each procedure will be in accordance with the current legal provisions for each type of administrative procedure.

Article 2. Agencies and units implementing the inter-connected process

1. The receiving and returning section of the Department of Labor - Invalids and Social Affairs of Dong Nai province at the Center of Public Administration of Dong Nai province (hereinafter below) called the Receiving Department of the Department of Labour, Invalids and Social Affairs) is the focal point to receive dossiers and return results for inter-connected procedures carried out under this Process.

2. The one-stop center of the Department of Justice, Department of Labor, War Invalids and Social Affairs of Dong Nai province is the unit that receives and transfers dossiers of application for issuance of judicial record cards and work permits to employees. The specialized department processes and returns the results to other departments according to the process.

3. Department of Labor, War Invalids and Social Affairs of Dong Nai province is the agency that handles procedures for granting work permits to foreign workers working in enterprises outside the Dong Nai industrial zone.

4. The Department of Justice of Dong Nai province is the agency that handles procedures for granting judicial record cards to foreign workers already residing in Vietnam.

5. Postal service provider is a unit that participates in the transfer of administrative documents between agencies and performs the service of receiving and returning results at the request of enterprises carrying out administrative procedures.

Chapter II

IMPLEMENTATION PROCESS

Article 3. Procedures for handling dossiers in the inter-connected implementation process

1. In the process of inter-operating implementation, enterprises only have to submit 01 set of dossiers including the components as prescribed. of two inter-connected administrative procedures for the receiving department of the Department of Labor - Invalids and Social Affairs. In case there are overlapping documents between the two procedures, the applicant only needs to submit 01 certified true copy or 01 photocopy (with the original for comparison).

2. The composition of dossiers for issuance of judicial record cards and dossiers for issuance of work permits to foreign workers shall comply with the provisions of the Labor Code, the Law on Judicial Records and guiding documents.

Chapter III

ORGANIZATION OF IMPLEMENTATION

Article 4. Office of the Provincial People's Committee The

Office of the Provincial People's Committee is responsible for coordinating with the Department of Labor, War Invalids and Social Affairs and the Department of Justice to advise and submit to the Chairman of the Provincial People's Committee the implementation of the Decision on announcement of procedures. administrative connection under this Process.

Article 5. Responsibilities of the Department of Labor, War Invalids and Social Affairs and the Department of Justice

1. To publicize the connection process; advise the Chairman of the Provincial People's Committee to decide to announce the inter-connection procedures according to this Process.

2. Coordinating in organizing training, guiding professional processes, requirements and procedures, how to use the one-stop public service system for the contingent of cadres and civil servants to carry out inter-connected procedures of the Department of Labor. - Invalids and Social Affairs and Department of Justice.

3. Coordinating in deploying information and propagating in appropriate forms, widely disseminating it so that organizations and individuals inside and outside Dong Nai province can easily access and implement when there is a need.

4. The Department of Labor, War Invalids and Social Affairs shall assume the prime responsibility for monitoring the implementation of this Process, act as the focal point for receiving information, and coordinate with relevant agencies to exchange, agree and submit to the Chairman. Provincial People's Committee decided to consider amending this Process.

Article 6. Department of Information and Communications

1. Coordinating with the Department of Labor - Invalids and Social Affairs, the Department of Justice and the Office of the Provincial People's Committee to update this process on the Electronic Single Window (Egov) of the company. conscious.

Article 7. Provincial Post Offices

1. Strictly comply with regulations on receiving and returning results of administrative procedures settlement via postal services at the request of organizations and individuals.

2. Coordinating with competent agencies in guiding inter-connection procedures to train and guide postal staff on professional processes related to the receipt and return of documents and results of handling procedures administrative.

3. Organize the collection of fees and charges for handling administrative procedures, charges for document delivery services, and results of handling administrative procedures via postal services. To fully and on time pay fees and charges collected from organizations and individuals to competent agencies.

4. Disseminate widely to organizations and individuals about receiving dossiers and returning results of administrative procedures settlement via postal services./.

 

APPENDIX

IMPLEMENTING INTERNATIONAL ADMINISTRATIVE PROCEDURES FOR ISSUANCE OF JUSTICE RECORDS DATA NO.01, NO.02 AND ISSUANCE OF WORKING PERMITS FOR FOREIGN EMPLOYERS WORKING IN THE FOREIGN INDUSTRIAL INDUSTRIAL ENTERPRISEFOREIGN ENTERPRISE).

1. Procedure:

- Step 1: Enterprise or individual prepares a full set of documents and submits the application. file to the reception department of the Department of Labor - Invalids and Social Affairs at the Public Administration Center of Dong Nai province.

Receiving section of the Department of Labor - Invalids and Social Affairs shall receive dossiers, check the completeness and legality of records:

+ If the dossier is incomplete component profile or legality under regulations, civil servants are responsible for guiding enterprises to re-prepared dossiers;

+ In case the application meets the requirements, receive, enter the application information into the one-stop software, print the receipt and schedule a date to return the results,

- Step 2: Transfer the dossier for issuance of the personal curriculum vitae. law to the Department of Justice for settlement; transfer the work permit dossier to the Department of Labor - Invalids and Social Affairs. In case of receiving paper documents, the receiving department of the Department of Labor, War Invalids and Social Affairs will scan the entire dossier and transfer the necessary data to the Department of Justice to handle the procedure for granting resumes. - Step 3: The Department of Justice processes the criminal record file, enters the status of the results of the application, scans the results of the criminal record card and transfers the settlement results to the Department of Labor, War Invalids and Social Affairs. festival.

In case the dossier is ineligible for settlement of a criminal record card, within 03 working days from the date of receipt of the dossier, an additional notice of ineligibility for settlement shall be sent to the Department of Labor and War Invalids. and Society and business to adjust and supplement.

The results of the Criminal Record and Additional Notice of Ineligibility are sent through the post office and the egov data system.

- Step 4: The Department of Labor, War Invalids and Social Affairs processes work permit application, input the results of the application and hand over the result of the application (Work Permit) to the receiving and returning Department. of the Department of Labor, War Invalids and Social Affairs to pay businesses.

In case the application does not fully satisfy the conditions of the work permit granting procedure, a written explanation of the reason shall be sent to the enterprise and a notification shall be sent to the enterprise for adjustment and supplementation.

- Step 5: The result-receiving and returning department of the Department of Labor - Invalids and Social Affairs returns the results directly or through the postal service system to enterprises.

2. Method of implementation:

- Submit directly at the Provincial Public Administration Center (6th Floor, Sonadezi Building, Street 1, Bien Hoa 1 Industrial Park, An Binh Ward, Bien Hoa City, Dong Nai Province);

- By postal service upon request;

3. Composition and number of dossiers:

3.1. Components of the application:

a) Dossier for issuance of a criminal record card

- A declaration requesting the issuance of a criminal record card according to the prescribed form (Form No. 03/2013/TT-LLTP; Form No. 04/2013/TT-LLTP) ).

- A copy of the people's identity card, citizen identification card or passport of the person issued with the judicial record card; Copy of household registration book, temporary residence book, certificate of permanent or temporary residence of the person who is issued with a judicial record card (if a photocopy is submitted, the original must be presented for comparison. for comparison, submit a certified true copy as prescribed by law).

- Power of attorney in case of authorizing another person to carry out the procedures for requesting the issuance of a judicial record card No. 1 (in case the authorized person is the father, mother, wife, husband or child of the authorizing person, it is not necessary to issue a letter of authorization). written authorization but must present documents proving the relationship). The power of attorney must be notarized and authenticated in accordance with Vietnamese law.

Individuals requesting the issuance of Criminal Record Cards No. 2 may not authorize others to carry out the procedures for requesting the issuance of Criminal Record Cards.

- A copy of the people's identity card, citizen identification card or passport of the authorized person (in case of authorization requesting the issuance of Criminal Record Certificate No.1).

In addition, the requester for the issuance of a judicial record card is subject to exemption or is required to provide judicial record information of students, people with meritorious services to the revolution, and relatives of martyrs (including fathers and mothers). birth, natural mother, wife (or husband), children (natural children, adopted children), people who have contributed to raising martyrs) must present papers to prove it.

b) Dossier for grant of work permitemployer's

- A health certificate or medical examination certificate issued by a competent foreign or Vietnamese medical agency or organization is valid for a period of 12 months from the date of signing the health conclusion to the date of submission. file.

- A written certification that he is not a criminal or is examined for penal liability in accordance with Vietnamese and foreign laws, valid for a period of 06 months, up to the time of application submission. May be as follows:

For foreigners already residing in Vietnam: Criminal record card issued by Vietnam.

For foreigners who have never resided in Vietnam: Judicial record card or written certification that the foreign worker is not a criminal or is prosecuted for penal liability by a foreign country.

- A written certification of being a manager, executive director, expert or technical worker, as follows:

For foreign workers who are managers or executives, they belong to one of the following schools: In the following cases:

+ Manager is the manager of the company and the manager of a private enterprise, including the owner of the private enterprise, the general partner, the chairman of the Members' Council, a member of the Members' Council, and The company president, the chairman of the board of management, members of the board of directors, the director or general director and individuals holding other managerial positions have the authority to sign transactions on behalf of the company in accordance with regulations. in the company's charter or as the head or deputy of the head of the agency or organization.

+ Chief Executive Officer is the person who heads and directly manages the units under agencies, organizations or enterprises.

For foreign workers who are experts, there must be one of the following documents:

+ A written certification of being an expert by an agency, organization or enterprise abroad, including: name of the agency or organization , enterprise certification; Information about the expert: full name, date of birth, nationality and profession of the expert in accordance with the job position that the foreign worker is expected to work in Vietnam.

+ Possessing a university degree or higher or equivalent and having at least 03 years of working experience in a specialized field of training suitable to the job position that the foreign worker is expected to work in Vietnam.

+ Foreigners who have a college degree or equivalent or higher and have a training profession suitable to their teaching expertise at foreign language training and retraining institutions (foreign language centers), educational institutions preschool education.

+ Foreign teachers must have at least a university degree in pedagogy or equivalent (university degree and certificate of pedagogy or certificate of general education) to teach at educational institutions. Common.

For foreign workers who are technical workers, the following papers are required:

+ Proof or written certification of overseas agencies, organizations or enterprises that they have received specialized training. technical or other major with a period of at least 01 year suitable to the position in which the foreign worker is expected to work in Vietnam;

+ Papers proving that the foreign worker has at least 03 years of working experience in a specialized training that is suitable for the job position in which the foreign worker is expected to work in Vietnam.

For some occupations, jobs, documents certifying professional qualifications, technical of foreign workers being replaced by one of the following documents:

+ Paper recognized as craftsmen of traditional crafts issued by a competent authority of a foreign country;

+ Documents proving the experience of foreign football players;

+ Air transport aircraft driver's license issued by a competent Vietnamese agency to foreign pilots;

+ An aircraft maintenance license issued by a competent Vietnamese agency to foreign workers doing aircraft maintenance.

- 02 color photos (size 4cm x 6cm, bare head, front view, clear face, clear ears, no glasses, white background), photos taken not older than 06 months by the time of application submission.

- A copy of the passport or a valid document in lieu of a passport or a valid international travel document as prescribed by law.

Health certificate; written confirmation that the person is not an offender or is being examined for penal liability; The written certification of being a manager, executive director, expert or technical worker is 01 original or 01 notarized copy as prescribed by Vietnamese law or foreign law, if in foreign language. For foreign employees working in the form of intra-enterprise relocation: Document of the foreign enterprise sending to work at the enterprise's commercial presence foreign companies in the territory of Vietnam and the documents proving that the foreign workers were foreign companies that recruit before working in Vietnam for at least 12 months is one of the following documents:

+ Van the employer's confirmation that the foreign worker has been recruited.

+ Labor contract.

+ Deciding to recruit foreign workers.

+ Certificate of tax payment or insurance of foreign workers.

For foreign employees working in the form of contracts or agreements on economics, commerce, finance, banking, insurance, science and technology, culture, sports, education , vocational training and medical care: Contract or agreement signed between the Vietnamese side and the foreign side, in which there must be an agreement on the foreign workers working in Vietnam;

For foreign workers in the form of service providers under contract: Service supply contract signed between the Vietnamese side and the foreign side and the document proving that the foreign worker has worked. for a foreign enterprise that has not had a commercial presence in Vietnam for at least 02 years is one of the following documents:

+ The employer's written certification of having recruited foreign workers.

+ Labor contract.

+ Deciding to recruit foreign workers.

+ Certificate of tax payment or insurance of foreign workers.

For foreign workers working in the form of service offering, there must be a document from the service provider sending the foreign worker to Vietnam to negotiate service provision;

For foreign workers working under the form of working for foreign non-governmental organizations and international organizations in Vietnam that are permitted to operate in accordance with Vietnamese law: Certificate of non-governmental organization foreign governments and international organizations permitted to operate in accordance with Vietnamese law;

For foreign workers working in the form of persons responsible for establishing commercial presence: Document of service provider sending foreign workers to Vietnam to establish commercial presence of supplier provide that service;

For foreign employees working in the form of managers, executives, experts or technicians who participate in activities of foreign enterprises that have established commercial presence in Vietnam: Documents proving that the foreign worker is allowed to participate in the activities of that foreign enterprise.

- For foreign workers who have been granted a work permit and are still valid but working for another employer at the same job position stated in the work permit as prescribed by law, the dossier shall include:

+ The employer's written request for a work permit;

+ A copy of the passport or a valid document in lieu of a passport or a valid international travel document as prescribed by law;

+ The original issued work permit or a notarized copy;

+ Papers related to foreigners (corresponding to each case stated in the content of granting work permits).

- For foreign workers who have been issued with a valid and valid work permit but work differently from the job position stated in the work permit as prescribed by law but do not change the employer, the The dossier includes:

- For a foreign worker who has been granted a work permit but it has expired but wishes to continue working in the same position as stated in the work permit as prescribed by law, the application shall include:

+ The employer's written request for a work permit;

+ A health certificate or medical examination certificate issued by a competent foreign or Vietnamese medical agency or organization is valid for 12 months from the date of signing the health conclusion to the date of submission. file;

+ A written certification that the person is not an offender or is being examined for penal liability;

+ 02 color photos (size 4cm x 6cm, white background, straight face, bare head, no colored glasses), photos taken within 06 months from the date of application

3.2. Number of dossiers: 01 set of documents for each procedure, in case there are overlapping documents between the two procedures, the applicant only needs to submit 01 certified copy and 01 photocopy.

4. Time limit for settlement:

The time to carry out inter-connected procedures under this Process is 18 working days, of which: the processing time for issuance of a criminal record card is 15 days, and the processing time for issuance of a work permit motion is 3 days.

5. Subjects performing administrative procedures: Individuals, organizations.

6. Agency implementing administrative procedures: Department of Labor, War Invalids and Social Affairs of Dong Nai province shall assume the prime responsibility for, and coordinate with the Department of Justice and the National Center for Judicial Records.

7. Results of administrative procedures: Work permits for foreign workers working in Vietnam; Judicial record cards No. 1, 2.

8. Fees and charges:

- Fees for issuance of work permits: 600,000 VND/ work permit (six hundred thousand dong).

- Fee for providing criminal record information 200,000 VND/time/person (two hundred thousand VND).

In case the person requesting the issue of a judicial record card requests to issue two judicial record cards in a single request, from the third card onward, the agency issuing the criminal record card will collect an additional 5,000 VND/. vouchers to cover the necessary expenses for the printing of the Criminal Record form.

9. Name of application form, declaration form:

- Written request for a work permit for foreign workers (Form No. 7 promulgated together with Circular No. 40/2016/TT-BLDTBXH).

- A declaration requesting the issuance of a judicial record card (Form No. 03/2013/TT-LLTP);

- A declaration requesting the issuance of a criminal record card (for individuals in case of authorization to request the issuance of a criminal record record card No. 1 and the individual being the parent of a minor who requests the issuance of a criminal record card). Law No. 2) (Form No. 04/2013/TT-LLTP).

10. Requirements and conditions for carrying out administrative procedures: Persons who are granted work permits and judicial record cards must fully satisfy the following conditions:

- Have full civil act capacity as prescribed by law. the law.

- Have health suitable for job requirements.

- As a manager, executive director, expert or technical worker.

- Not being a criminal or being examined for penal liability in accordance with Vietnamese and foreign laws.

- Get the written approval of the competent state agency on the employment of foreign workers.

11. Legal basis of administrative procedures:

- Labor Code 2012 (from Article 169 to Article 175);

- Law on Enterprise 2014;

- Law on Judicial Records 2009;

- Decree No. 111/2010/ND-CP dated November 23, 2010 of the Government detailing and guiding the implementation of a number of articles of the Law on Judicial Records;

- Decree No. 11/2016/ND-CP dated February 3, 2016 of the Government detailing the implementation of a number of articles of the Labor Code regarding foreign workers working in Vietnam;

- Joint Circular No. 04/2012/TTLT-BTP-TANDTC-VKSNDTC-BCA-BQP dated February 10, 2012 of the Ministry of Justice, Supreme People's Court, Supreme People's Procuracy, Ministry of Public Security The Ministry of National Defense shall guide the order and procedures for searching, verifying, exchanging and providing judicial record information;

- Circular No. 13/2011/TT-BTP dated June 27, 2011 of the Minister of Justice on promulgating and guiding the use of forms and samples of judicial record books;
